Welcome to Muse Content Club. These Terms of Service ("Terms") apply to your access to and use of musecontentclub.com (the "Site") and to any products you purchase from us. Please read them carefully.
By browsing the Site, creating an account or completing a purchase, you agree to be bound by these Terms. If you do not agree, please do not use the Site or purchase our products.
1. About us
Muse Content Club sells digital design products, including editable Canva templates, social media template packs, stock image bundles and related digital assets. We operate from New South Wales, Australia.
In these Terms, "we", "us" and "our" refer to Muse Content Club. "You" and "your" refer to the person accessing the Site or purchasing a product.
2. Eligibility
You must be at least 18 years old, or have the consent of a parent or guardian, to purchase from the Site. By placing an order you confirm that you meet this requirement and that the information you provide is accurate and complete.
3. Your account
You may be able to create an account to access your purchases. You are responsible for keeping your login details secure and for all activity that occurs under your account. Please notify us immediately if you believe your account has been accessed without your permission.
We may suspend or cancel an account that we reasonably believe has been used to breach these Terms.
4. Products and delivery
All products sold on the Site are digital. Nothing is physically shipped.
After your payment is confirmed, you will receive access to your files by email, by download link, or by a Canva template link, depending on the product. Delivery is generally instant, though occasional short delays can occur.
It is your responsibility to provide a correct email address at checkout and to check your junk or spam folder if your delivery email does not arrive. If you have not received your product, please get in touch with us through the Site.
5. Canva templates
Most of our products are supplied as Canva template links.
- You will need a Canva account to access and edit these templates. A free Canva account is sufficient unless a product listing states otherwise.
- Some elements shown in previews may be Canva Pro assets, stock photos or fonts used for demonstration purposes. These may display differently on a free account and can be swapped for free alternatives.
- Access to Canva is governed by Canva's own terms of use, which are separate from these Terms and outside our control.
- We are not affiliated with, endorsed by, or sponsored by Canva. Canva is a trademark of its respective owner and is referenced here only to describe how our products are used.
We cannot guarantee ongoing availability of any third party platform. If Canva changes its features, pricing or asset library in a way that affects a template, we will do our best to help but we are not responsible for those changes.
6. Licence and permitted use
When you purchase a product, you receive a limited, non-exclusive, non-transferable licence to use it. You do not acquire ownership of the design, the underlying files or any intellectual property in them.
You may:
- Edit and customise the templates for your own business or personal use
- Use the finished designs commercially, including in your own marketing, social media, client work, website and printed materials
- Use the templates across multiple projects for a single business that you own or operate
- Use finished designs created from our templates for paying clients as part of a service you provide
You may not:
- Resell, share, gift, licence, sublicense or distribute the original template files or template links, whether free or paid
- Sell the templates as templates, or as part of any template pack, membership, course, bundle or digital product
- Share your download links or Canva template links with anyone else, including team members outside your business, other businesses or online groups
- Upload the files to any file sharing site, marketplace, cloud folder or community that others can access
- Claim the original designs as your own creation
- Use the products to create a competing product or service
- Register, or attempt to register, any trademark or copyright over the templates or any design substantially similar to them
- Use the products in any unlawful, misleading, defamatory or offensive way
If you need a licence for a larger team, an agency arrangement or another use not covered above, please get in touch with us to discuss it.
7. Intellectual property
All content on the Site, including our products, designs, layouts, graphics, text, branding, logos and photographs, is owned by Muse Content Club or our licensors and is protected by Australian and international copyright and trademark law.
Nothing in these Terms transfers ownership of any intellectual property to you.
Any breach of the licence terms in section 6 may result in immediate termination of your licence and access to your files, without refund, and may expose you to legal action.
8. Pricing and payment
All prices are listed in the currency shown at checkout and are subject to change without notice. Prices displayed at the time you place your order are the prices that apply to that order.
Payment is processed through our third party payment providers. We do not store your full payment details. Your use of those services is subject to their own terms and privacy policies.
We reserve the right to refuse or cancel any order, including where a product has been listed at an incorrect price or where we suspect fraudulent activity. If we cancel an order that you have already paid for, we will refund that payment in full.
9. Discounts and promotions
Discount codes and promotional offers are valid only for the period and on the products specified, cannot be applied retrospectively to completed orders, and cannot be combined unless we state otherwise. We may withdraw or amend any promotion at any time.
10. Refunds
Our products are digital and are delivered instantly, so we do not offer refunds, returns or exchanges for change of mind. Full details, including how we handle faulty files and delivery issues, are set out in our Returns and Refund Policy, which forms part of these Terms.
11. Acceptable use of the Site
You agree not to use the Site in any way that is unlawful, that interferes with its operation or security, that attempts to gain unauthorised access to any part of it, or that involves scraping, copying or harvesting content or data by automated means.
12. Third party links
The Site and our products may contain links to third party websites, tools or resources. These are provided for convenience only. We do not control them, we do not endorse them, and we are not responsible for their content, products or practices.
Some links may be affiliate links, which means we may earn a small commission if you make a purchase. This never affects the price you pay.
13. Disclaimers
Our products are creative and educational tools. They are provided on an "as is" basis.
We make no guarantee that any product will produce a particular result for your business, including growth in followers, engagement, enquiries, sales or income. Results depend on many factors outside our control, including your own effort, market and audience.
To the extent permitted by law, we do not warrant that the Site will be uninterrupted, error free or free of harmful components.
14. Australian Consumer Law
Nothing in these Terms excludes, restricts or modifies any right or remedy, guarantee, warranty or other term implied by the Australian Consumer Law or any other law where to do so would be unlawful.
Our products come with guarantees that cannot be excluded under the Australian Consumer Law. Where we are permitted to limit our liability for a breach of a consumer guarantee, our liability is limited, at our option, to resupplying the product or paying the cost of having it resupplied.
15. Limitation of liability
Subject to section 14, and to the maximum extent permitted by law, our total liability to you arising out of or in connection with these Terms, the Site or any product is limited to the amount you paid us for the product giving rise to the claim.
We are not liable for any indirect, incidental, special or consequential loss, including loss of profit, loss of revenue, loss of data, loss of goodwill or business interruption.
16. Indemnity
You agree to indemnify us against any claim, loss, damage or expense arising from your breach of these Terms, your misuse of any product, or your infringement of the rights of any third party.
17. Privacy
We collect and handle personal information in accordance with our Privacy Policy, which forms part of these Terms.
18. Termination
We may suspend or terminate your access to the Site, your account or any product at any time if you breach these Terms. Sections relating to intellectual property, licence restrictions, disclaimers, limitation of liability and indemnity survive termination.
19. Changes to these Terms
We may update these Terms from time to time. The current version will always be published on the Site with the date it was last updated. Changes apply from the date they are published. Your continued use of the Site after that date means you accept the updated Terms.
20. Governing law
These Terms are governed by the laws of New South Wales, Australia. You and we submit to the non-exclusive jurisdiction of the courts of New South Wales and the courts competent to hear appeals from them.
21. General
If any part of these Terms is found to be invalid or unenforceable, that part will be severed and the remainder will continue to apply. Our failure to enforce any provision is not a waiver of our right to enforce it later.
These Terms, together with our Returns and Refund Policy and Privacy Policy, form the entire agreement between you and us regarding your use of the Site and our products.
